Résumé: ملخص: تطورت وسائل دفع قيمة الحاجات على مر التاريخ والعصور بأشكال مختلفة بدءا من أسلوب المقايضة ثم استخدام النقود المعدنية مرورا بالنقود الورقية ثم نشأت فكرة الشيكات كوسيلة للوفاء ثم تطورت هذه الوسيلة إلى النقود البلاستيكية أو ما يعرف ببطاقات الدفع الالكتروني التي تعد في الوقت الراهن البديل العصري للنقود؛ وحيث أن بطاقات الدفع الالكتروني ترتبط بالتسوق عبر الانترنت نلاحظ أنها وثيقة الصلة بالتجارة الالكترونية ويمكن عن طريق هذه الرابطة أو الصلة تحويل المبالغ المالية من حسابات لأخرى. وإذا كانت خدمة الدفع الإلكتروني، ستمكن الزبائن من دفع فواتيرهم عبر الإنترنت، والقيام بالتعاملات التجارية اليومية بكل سهولة، وما تتيحه من تسهيلات أخرى فإن هذا الأسلوب في التعامل أيضا سينجر عنه العديد من التجاوزات القانونية، ونحاول في هذه الورقة أن نركز على تلك التجاوزات التي تصل الى حد الجريمة الجنائية؛ لنبحث عن المسؤولية الجنائية المترتبة عنها؟ وعن مجال هذه المسؤولية الجنائية من حيث الأشخاص. وبناء عليه؛ ولما كانت المعاملة الالكترونية ثلاثية الأطراف فإننا سنتناول دراسة المسؤولية الجنائية عن الاستخدام غير المشروع من قبل حامل البطاقة، ومن قبل مصدر البطاقة، ومن قبل الغير..
