مفهوم دعوى الإلغاء وتمييزها عن الدعاوى الإدارية الأخرى

Résumé: تعتبر دعوى الإلغاء من أهم الدعاوى القضائية الإدارية، فهي تهدف إلى الحفاظ على مبدأ المشروعية من خلال إلغاء القرارات الإدارية المخالفة للقانون، يرفعها صاحب الشأن المخاطب بالقرار للمطالبة بإلغاء أو إعدام قرار إداري صدر مخالفا للقانون، فدعوى الإلغاء باعتبارها دعوى مشروعية يكون موضوعها دائما قرارا إداريا يفصل القاضي في مدى مشروعيته أيا كانت السلطة التي أصدرته، ويمكن القول بأن دعوى الإلغاء تخاصم القرار الإداري وليس جهة الإدارة التي أصدرته. The cancellation action is considered one of the most important administrative lawsuits, it aims to maintain the principle of legality through the cancellation of administrative decisions contrary to the law, submitted by the concerned person addressing the decision to demand the cancellation of an administrative decision contrary to the law. The subject of the cancellation action is always an administrative decision that determines its legitimacy as an administrative judge, it can be argued that the cancellation action contradicts the administrative decision and not the administration that issued it.
