دور الالتزام بالإعلام في حماية المستهلك من المواد الصيدلانية

Résumé: يعتبر الالتزام بالإعلام أحد الالتزامات الأساسية المقررة لحماية المستهلك الطرف الضعيف، فهو يساهم في تحقيق سلامة المستهلك وتنوير إرادته خاصة في مجال المواد الصيدلانية التي تعتبر مواد خطيرة وحيوية في آن واحد، ولِدى يقع على عاتق الصيدلي باعتباره متدخلا إعلام المستهلك بكافة المعلومات والبيانات الضرورية المتعلقة باستعمالها للتقليل من مخاطرها، ولذلك وجب على المشرع الجزائري تعزيز الحماية المقررة للمستهلك لمواجهة تخلف الصيدلي عن التزامه بالإعلام. L’obligation d’information est considérée comme l'une des obligations fondamentales établies pour la protection du consommateur qui est la partie faible du contrat, car il contribue à assurer la sécurité du consommateur et à éclairer sa volonté, notamment dans le domaine des produits pharmaceutiques considérés comme produits dangereux et vitale à la fois, ainsi il advient de la responsabilité du pharmacien d’informer le consommateur de toutes les informations et données nécessaire liée à leurs utilisation afin de réduire leurs dangers, et c’est pour cette raison, le législateur algérien doit renforcer cette protection pour faire face à la non-adhésion du pharmacien à l’obligation d’information The obligation of information is considered one of the basic obligations established to protect the consumer who is the weak party, as it contributes to achieving the safety of the consumer and enlightening his will, especially in the field of pharmaceutical substances that are considered dangerous and vital at the same time, and when it is the responsibility of the pharmacist as an intervening person to inform the consumer of all necessary information and data related to their use to reduce their dangers, and therefore the Algerian legislator had to strengthen this protection to confront the pharmacist’s failure to his obligation of information
