عدول المستهلك عن العقد في مجال خدمات الاتصالات

Résumé: إن موضوع عدول المستهلك عن التعاقد خاصة في عقود خدمات الإتصالات في مواجهة مقدم الخدمة موضوع جدير بالدراسة لما يكتسيه الموضوع من الحداثة والجدة،فالرفاهية التي وفرتها الثورة الرقمية المتسارعة للاتصالات أزداد معها مخاطر مستحدثة تحدق بالمصلحة المادية والمعنوية للمستهلك،والجهود التشريعية مدركة لهذا التحول،فهي تحاول توفير حماية أكثر للمستهلك من خلال قوانين خاصة لعدم كفاية القواعد العامة وعجزها عن تحقيق التوازن العقدي،والعدول عن العقد الية مستحدثة لحماية الطرف الضعيف وهو المستهلك. Abstract: The subject of the consumer's retraction from the contract especially in the communication services contracts opposite the provider of the service is a subject worthy to be studied as it is new and recent. The luxury provided by the accelerating digital revolution of communications gives birth to new risks threatening the consumer's material and moral interest. The legislative efforts take into consideration this change, as it is trying to provide more protection to the consumer through special laws for the insufficiency of general rules and their incapacity to achieve the contractual balance and the abstention from concluding contract is a new mechanism to protect the weaker party i.e. the consumer.
