الاتفاقية الجماعية للعمل: عقدية التكوين تنظيمية الآثار

Résumé: تكتفي التشريعات الحديثة بوضع الحد الأدنى من القواعد الحمائية، وتترك وضع القواعد التي تنظم علاقات وشروط وظروف العمل، للاتفاقيات الجماعية حسب ظروف كل مؤسسة أو قطاع النشاط، تلك الاتفاقيات التي يتم إبرامها بتوافق الارادة بين مستخدم أو مجموعة مستخدمين أو منظمة تمثيلية لهم أو أكثر من جهة، ومنظمة تمثيلية للعمال أو أكثر من جهة اخرى، وفق القواعد العامة لإبرام العقود، ما يضفي عليها طابع تعاقدي. إلا أن هذا المنتوج الاتفاقي يتضمن قواعد عامة ملزمة ومجردة، تطبق على أطرافها الحالية وعلى الأطراف المنضمة لها، كما تطبق على العقود الفردية المبرمة أو التي ستبرم مستقبلا، مما يعطي لهاته الاتفاقيات الصبغة التنظيمية، ما يتطلب توضيح مميزات الطابع العقدي للاتفاقيات عند الإبرام، ومميزات طابعها التنظيمي عند التطبيق. Modern legislation tends to establish the minimum protective rules and leave the establishment of rules governing work relations, conditions, and terms to collective agreements according to the circumstances of each institution or sector of activity. These agreements are concluded by mutual consent between an employer or a group of employees or a representative organization for them, or more than one party, and a workers' representative organization or more than one other party, following the general rules for contract conclusion, giving them a contractual character. However, this contractual product includes general, binding, and abstract rules that apply to its current parties and to parties joining it. They also apply to individual contracts concluded or to be concluded in the future, giving these agreements a regulatory nature, which requires clarifying the distinguishing features of the contractual aspect of agreements at the time of conclusion, as well as their organizational characteristics during implementation.
