المسؤولية الجزائية عن جرائم تلويث البيئة في التشريع الجزائري

Résumé: تتناول هذه الورقة البحثية المسؤولية الجنائية عن جرائم تلوث البيئة، وهي من أهم المتطلبات في العالم عامة والجزائر خاصة، فالعيش في بيئة آمنة ونظيفة خالية من التلوث يشكل ركيزة أساسية لبقاء المجتمع في سياق مرتبط بما يعرف بالأمن البيئي. تعد جريمة تلوث البيئة والمسؤولية الجنائية المترتبة عليها من المواضيع الحديثة في مجال الدراسات القانونية - وخاصة المجال الجنائي، حيث أن التدخل القبلي لتوفير الحماية المسبقة وتفعيل التوعية أمر مهم لنجاح الحماية الجنائية للبيئة. لقد كان الأمر يتعلق بمن هو المسؤول عن الجريمة بقدر ما كان الأمر يتعلق بضرورة الحفاظ على عناصر البيئة عامة والهواء خاصة.This research paper deals with criminal responsibility for environmental pollution crimes, which is one of the most important requirements in the world in general and Algeria in particular, as living in a safe and clean environment free of pollution constitutes a fundamental pillar for the survival of society in a context linked to what is known as environmental security. The crime of environmental pollution and the criminal responsibility resulting from it are modern topics in the field of legal studies - especially the criminal field, as prior intervention to provide prior protection and activate awareness is important for the success of criminal protection of the environment. It was a matter of who is responsible for the crime as much as it was a matter of the need to preserve the elements of the environment in general and the air in particular.
