مسألة الإطلاع على الأرشيف في التشريع الجزائري: رؤية تحليلية
Résumé: تتناول هذه الدراسة عملية الاطلاع على الأرشيف التي تعد من بين أبرز المهام والأهداف التي تسعى إليها مختلف مراكز الأرشيف، وذلك من خلال تطوير وتعزيز خدماتها وتسهيل عمليات الوصول إلى مختلف أرصدتها الأرشيفية، هذه العملية المهمة والتي تعتبر كنتيجة لمختلف المهام الأرشيفية الأخرى تبقى مضبوطة وخاضعة لجملة من التشريعات الوطنية على مستوى كل دولة، والجزائر واحدة من هذه الدول فهي تملك قانون أرشيف وطني يضبط عملية الاطلاع، كما أن هناك مجموعة من القوانين العالمية الأخرى التي تسري في هذا المجال لكن برؤى وتوجهات مختلفة، تأتي هذه الدراسة لتسلط الضوء على أهم التشريعات الوطنية الجزائرية المحيطة بعملية الاطلاع على الأرشيف، مع إبراز الاختلاف الذي لاقته هذه النصوص بدءا من المصطلح وإشكالية توظيفه علميا وتطبيقيا، وذلك اعتمادا على المنهج التحليلي بغرض توضيح المعوقات التي قد تنجم عن هذا الفراغ القانوني وانعكاساته الحالية والمستقبلية، لتنتهي الدراسة في الأخير بوضع جملة من المقترحات. This study deals with the process of accessing archives, which is one of the most important tasks and aims of various archive centers through developing and reinforcing its services and facilitating access to their archive records. This key process, which is considered as a result of various archival tasks, remains regulated and subject to a number of national legislation in all countries. Algeria is one of these countries as it has a national archives law that regulates the process of accessing archives along with other international laws in force in such matter but with other visions and orientations. This study comes to shed light on the most important Algerian national legislation on the process of consulting archives by highlighting the difference that these texts have encountered, starting with terminology and the issue of its use scientifically and practically. This research is based on an analytical method aiming at clarifying obstacles that may arise from this legal vacuum and its current and future implications. Finally, the study ends up with a number of recommendation and suggestions.
