رقابة القاضي الإداري على القرارات الإدارية في الظروف الاستثنائية

Résumé: تعد الرقابة القضائية على تدابير الضبط الإداري في الظروف الاستثنائية الوسيلة الأنجع لضمان حماية الحقوق والحريات من تعسف الإدارة التي تتوسع سلطاتها لحماية النظام العام، اذ يجوز لها اتخاذ تدابير استثنائية قد تكون غير مشروعة لو صدرت في الظروف العادية وتتحمل بذلك مسؤوليتها في تعويض الأشخاص لجبر الأضرار اللاحقة سواء بإثارة مسؤوليتها على أساس الخطأ أو بدون خطأ. يضيق نطاق رقابة القاضي الإداري على الإجراءات الاستثنائية فله دور وقائي في اتخاذ تدابير مؤقتة عند الفصل في الدعاوى( الإلغاء، التعويض)، كما يمكن له إلغاء القرارات الضبطية الإدارية غير المشروعة ويكون ذلك في نطاق المشروعية الاستثنائية . Summary Judicial review of administrative police measures in exceptional circumstances is essential to guarantee the protection of rights and freedoms against abuse by administrative police authorities whose power extends to the protection of public order. These authorities can take exceptional measures which could be illegal if issued under normal circumstances, thus assuming their responsibility to compensate people for the damages caused, whether or not there is fault. The control exercised by the administrative judge over exceptional procedures is restricted. It has a preventive role in the taking of provisional measures in the event of ruling on an emergency action, it can annul illegal administrative decisions, it is within the framework of exceptional legality
