المنافسة غير النزيهة في التشريع الجزائري

Résumé: لقد سن المشرع الجزائري آليات قانونية تحدد و تضبط الممارسات التجارية، عن طريق فرض القانون رقم 04/02 المحدد للقواعد المطبقة على الممارسات التجارية المعدل والمتمم، حيث جاء هذا القانون لحظر العديد من الممارسات التجارية غير النزيهة المخالفة للأعراف التجارية، إن قواعد المنافسة وضعت لحماية السوق وحرية المنافسة بصفة عامة ومصالح الأعوان الاقتصاديين بصفة خاصة. تتجلى دراسة هذا الموضوع في الأهمية البالغة التي أصبحت تكتسيها نزاهة الممارسات التجارية، مع توضيح جهود المشرع الجزائري في تنظيم السوق، العلاقات بين الأعوان الاقتصاديين، علاقة العون الاقتصادي في مواجهة المستهلك، وكذا مراقبة السوق من خلال تفعيل آليات معينة منح لها العديد من الصلاحيات التي من شأنها أن تسهل في الرقي بالنهوض بالاقتصاد الوطني.
