ولاية الدولة على الوقف و فوات المقصود منه

Résumé: بدأ الوقف ظاهرة تعبدية بسيطة، ثم تطور وتوسع وأصبح يغطي مختلف احتياجات المجتمع، لذا تم التفكير في إنشاء نظام لإدارته والمحافظة عليه، وكان الواقف هو من يدير وقفه بنفسه في البداية أو يعهد به إلى ناظر، ولكن ازدياد هذه الأموال، وضخامتها، وتنوعها، والمشاكل التي برزت بمرور الوقت أصبح لزاما على الدولة التدخل من أجل ضبط إدارة هذه الأموال، واحترام شروط الواقفين، وكان القضاء أول متدخل في إدارة الأوقاف من خلال الإشراف عليها في حالة عدم وجود ناظر أو نص الواقف على ذلك، إلا أن إتباع معظم الدول العربية النمط الغربي في بناء دولها جعل هذه الدول تتدخل في كل مناحي الحياة ومنها الوقف، وذلك بالتدخل في إدارته من خلال الولاية عليه وهو ما أدى إلى تفويت الغرض منه في كثير من جوانبه.
