النظام القانوني لتصفية النفقات العامة

Résumé: لا يمكن للإدارة العامة أن تشبع الحاجات الأساسية وتحافظ على النظام العام إلا بالقيام بوظيفة الضبط الإداري وإبرام الصفقات العمومية، الأمر الذي يفرض عليها أن تنفق أموالها حتى تتحقق هذه الأغراض، لكن قانون المحاسبة العمومية أحاط عملية الإنفاق بضوابط دقيقة منها ما يتعلق بضوابط تصفية النفقات العامة. لذا فإن هذه الدراسة تقف عند مرحلة جزئية من المرحلة الإدارية لصرف النفقات العامة والتي تتعلق بتصفية النفقة، حيث تتولى تحديد شروطها وضوابطها القانونية حتى تكون هذه الأخيرة مشروعة. الكلمات المفتاحية : النفقات العامة - مرحلة التصفية - الآمر بالصرف - شهادة أداء الخدمة - تقدير مبلغ النفقة. Abstract: The public administration cannot satisfy basic needs and maintain public order except by performing the function of administrative control and concluding public contracts, which requires it to spend its funds to achieve these purposes. However, the public accounting law has surrounded the spending process with precise controls, including those related to the settlement of public expenditures. Therefore, this study focuses on a partial stage of the administrative process of public expenditure, which pertains to the settlement of expenses, where it determines its conditions and legal regulations to ensure their legitimacy.
