اليمين الدس تورية في القانون الجزائري

Résumé: يتمثل موضوع الدراسة المكانة القانونية لليمن الدستورية، بناء ع إشكالية مفادها: كيفنظم المشرع الجزائري لليمين الدستورية؟ و قد تطرقت هذه الدراسة إلى مقارنة الأحكام القانونية المتعلقة باليمن الدستورية في كل الدساتير، إن أهم مواضيع اليمين الدستورية القانونية التي لها تأثير كبير على مسؤولية الشخص المكلف بآدئها، إذ لم يضع الدستور الجزائري لعام 2016 والدساتير السابقة 1963 و1976 و1989 و1996 لم يضع المواد المتعلقة باليمين الدستورية ضمن نصوص واضحة لا لبس فيها ولا غموض بل إن العديد منها يحتاج إلى التفسير وإعادة النظر فيها وتقويمها من أجل وضع نظرية لليمين الدستورية في ضوء المبادئ العامة التي تحكم مسؤولية الشخص الذي يؤدي اليمين وموقف الدساتير السابقة مع إجراء مقارنة بدساتير أخرى.The subject of the study is the legal status of the constitutional oath, a comparative study between the Algerian constitutional system and comparative constitutional systems. And a comparison of the legal provisions related to the constitutional oath in all Algerian constitutions, starting from the constitution of 1963 to the constitutional amendment of 2016, and various other constitutions that were chosen based on the importance of the legal provisions therein. This study concludes that the legal position of the constitutional oath in the Algerian constitutional system is of medium.
