Résumé: نتناول في هذا المقال موضوع المعرفة الفنية لما لها من أهمية اقتصادية و قانونية في الحياة العملية ، بحيث تحتل المعرفة الفنية مكانا هاما و بارزا بين موضوعات الملكية الصناعية و ذلك لما تثيره من مسائل شائكة و معقدة سواء على know-how الصعيد الوطني في الدول الصناعية الكبرى ، أو على الصعيد الدولي بمناسبة نقلها من تلك الدول إلى الدول النامية . وهذا ما جعلنا نبحث في الأساس و السند القانوني لحماية المعرفة الفنية بواسطة حق المؤلف و الحقوق المجاورة، لعدم توفر قانون خاص لحمايتها. This article is about knowledge and know-how, the most economically and legally important subject in scientific life. The knowledge of know-how is the most important among the subjects of industrial property, because of what it introduces at the national level in the industrial countries, or at the international level when it will be transmitted from its countries to the country of third world. All this pushed us to take research into the legal aspects of the protection of knowledge and know-how through copyright because of the absence of a right that protects.
