Résumé: الملخص: تعتبر فكرة النظام العام الجمالي أمرا مبتكرا لم يتحدد مضمونه في القانون الإداري إلا حديثا، وذلك باعتباره أحد عناصر النظام العام بمفهومه الحديث، فهو مرتبط ارتباطا وثيقا بالبلدية بصفتها الخلية الأساسية للدولة والتي تلعب دورا فعالا للمحافظة على النظام العام الجمالي. ولكن دور البلدية في المحافظة على النظام العام الجمالي لا يصل إلى الحد المأمول منه وذلك بسبب نقص الموارد المالية للبلدية أو ضعف الرقابة الممارسة في ذلك، دون أن ننسى نقص وعي المواطنين اتجاه جمالية بلديتهم ولعلّ التدهور البيئي والعمراني الذي يعيشه معظم بلدياتنا لخير دليل على ذلك. Abstract: The idea of an aesthetic public order is considered an innovative matter whose content has been determined in administrative law only recently, as it is one of the elements of public order in its modern sense, as it is closely linked to the municipality as the basic cell of the state that plays an effective role in maintaining the aesthetic public order. However, the municipality’s role in preserving the aesthetic public order does not reach the desired limit due to the lack of financial resources of the municipality or the weakness of oversight in practice, without forgetting the lack of awareness of citizens towards the aesthetics of their municipality and perhaps the environmental and urban deterioration that most of our municipalities are experiencing is evidence of that.
