التعاون الدولي كآلية لمكافحة التقليد والقرصنة في مجال حقوق الملكية الصناعية

Résumé: التقليد والقرصنة ظاهرة انتشرت بكثرة سواء في الدول النامية أو الدول المتقدمة؛ إذ أصبحت تتصدر قائمة أكثر الجرائم التي تستهدف مختلف أنواع حقوق الملكية الصناعية. فبالرغم من الإجراءات القانونية التي أقرتها العديد من الدول للتصدي لهذه الظاهرة إلاّ أنّها لم تتمكن من القضاء عليها بشكل نهائي وهذا بسبب بعدها الدولي الذي يتطلب أن تكون آليات مواجهتها ذات بعد دولي. كل ذلك أدى بالدول إلى التكتل في إطار ما يعرف بالتعاون الدولي لوضع آليات قانونية ملائمة وفعالة لمواجهة مختلف صور وأشكال التقليد والقرصنة التي تطال مختلف حقوق الملكية الصناعية؛ وذلك من خلال استعراض جهود المنظمات الدولية والإقليمية المتخصصة في هذا المجال، إضافة إلى ما قدمته الاتفاقيات والمعاهدات الدولية والإقليمية من أحكام وتدابير في هذا الصدد. Imitation and piracy is a widely spread phenomenon, whether in developing or developed countries. It has become top of the most crimes targeting various types of industrial property rights. Despite of the legal procedures adopted by several countries to deal with this phenomenon, it have not been able to eliminate it completely due to its international dimension which requires that the mechanisms should have an international dimension as well. All this had led countries to cluster in what is known as international cooperation to developed appropriate and effective legal mechanisms to counter the numerous forms of imitation and piracy that extend to different kinds of industrial property rights ; by displaying the efforts of international and regional organizations specialized in this field.
