جني الثمرات في تأصيل أحكام الكفارات -دراسة أصولية تقعيديّة مقارنة-

Résumé: تتمحور فكرة هذا المقال حول دراسة لأحكام الكفارات تأصيلاً وتقعيداً وتقصيداً، حيث جمعت أهمّ النصوص الشرعية المتعلقة بالكفارة ، وعقدت دراسة أصولية لها ، قصد استنباط الأحكام الشّرعية منها بواسطة قواعد أصول الفقه، وذلك لتضييق فجوة الخلاف الحاصل بين فقهاء الأمصار في هذا الباب المهم، من خلال وضع قواعد تأصيلية تنير للفقيه مسالك لدرء التعارض الحاصل بين هذه النصوص في ضوء مقاصد الشريعة الإسلامية. وخلص البحث إلى بيان مدى أثر التقعيد الأصولي في ضبط أحكام الكفارات قصد التعامل فيما استجدّ من النوازل المتعلقة بها. The idea of this article revolves around a study of the provisions of expiations, in terms of foundation, codification and purpose, where the most important legal texts related to expiation were collected, and a fundamental study was conducted for them, with the aim of deriving legal provisions from them by means of the principles of jurisprudence, in order to narrow the gap of disagreement between the jurists of the countries in this important matter, by establishing fundamental rules that illuminate the paths for the jurist to avoid the conflict between these texts in light of the objectives of Islamic law. The research concluded by stating the extent of the impact of fundamental codification in controlling the provisions of expiations in order to deal with the new incidents related to them.
