قانون المرور الجزائري في مواجهة تزايد الحوادث بين الواقع و إرادة التغيير

Résumé: ملخص: تزايد عدد الحوادث في السنوات العشر الأخيرة ساهم في تغيير سياسة المشرع الجزائري نحو تدعيم المنظومة الردعية بمجموعة من القوانين يمكن إعتبارها لأول وهلة أنها الأهم و الأصعب بالنظر إلى حجم العقوبات المفروضة على بعض المخالفات في قانون المرور، غير أن هذا التطور الكبير لم يصاحبه بالضرورة نقص في حوادث المرور، بل و على العكس فقد شهدت الجزائر وخلال نفس الفترة تزايدا كبيرا في عدد القتلى و الجرحى، إحتلت به للأسف المراتب الأولى في التصنيف العالمي للدول التي تقع فيها أكبر عدد لحوادث المرور. هذا التزايد المستمر في عدد الحوادث جعل المشرع الجزائري في الآونة الأخيرة يعيد النظر في النظام الردعي المعتمد على أساس تشديد العقوبة إلى تطوير نظام متكامل يسمح بإعادة هيكلة المنظومة القانونية لحركة المرور في الجزائر نذكر منها تفعيل الرقابة الدورية والدائمة على مستوى الطرقات، و كذا إحداث رخصة السياقة بالنقاط التي تعتبر كوسيلة بيداغوجية لها أهداف تربوية يمكن أن تساهم في التقليل من حوادث الطرقات في بلادنا، غير أنه يمكن القول بأن هناك بعض النقائص في جوانب أخرى في هذا النظام المستحدث و الذي يجب أخذها بعين الإعتبار للوصول إلى الأهداف المعلنة. .Abstract The number of car accidents has increased during the last decade, which has called for a change in the policy of the Algerian legislator towards the consolidation of the repressive system, via a number of texts that can be considered, from the outset, the more important and more dangerous, given the scope of the penalties provided for certain contraventions in the Highway Code. Nevertheless, this great development has not been accompanied by a decrease in road accidents, quite the contrary, the country has experienced, during the same period, a considerable increase in the number of road deaths and injuries, which has propelled Algeria to the top ranks of the countries victims of road accidents, according to the world ranking. This continuous increase in the number of road accidents has recently led the Algerian legislator to reconsider the repressive regime, which is based on the severity of penalties, to develop a comprehensive regime that allows the restructuring of the legal system of road traffic, in Algeria, especially the enhancement of periodical checks at a permanent scale and the instatement of point-record driving license as apedagogical means with educational goals that can contribute to the mitigation of road accidents in our country. However, it can be said that there are still a number of deficiencies, as regards other aspects of this new regime, which that must be taken into account to achieve the stated goals.
