الآثار الجماعية للتجنس بالجنسية الجزائرية (دراسة مقارنة)

Résumé: بسبب تأثير الشخص الأجنبي ، الذي حصل على الجنسية الجزائرية ، على أطفاله القاصرين ، تبنى المجلس التشريعي الجزائري ، مبدأ الجنسية نفسها في العائلة ، من خلال أخذ فكرة التفرد المطلق ، ومدد تأثير هذا التأميم لهم بقوة القانون ودون أي شروط ، بينما اعتمد الاتجاه المعاصر وأيد مبدأ الاستقلال في الجنسية في الأسرة للزوجة والأطفال البالغين ، باستثناء الاستثناء الوارد في المادة 11 من قانون الجنسية الجزائرية. ووفقاً لذلك ، لا يوجد أي تأثير على جنسية أجنبية على زوجته وأطفاله البالغين على الإطلاق ، من ناحية احترام إرادة الزوجة ، فيما يتعلق بالجنسية ، وتجنب وصف الأطفال البالغين باعتبارهم معالين . Because of the impact of the foreign person, who obtained Algerian nationality, on his minor children, the Algerian legislature adopted, the principle of the same nationality in the family, by taking the idea of absolute subsidiarity , and has extended the impact of this nationalization to them by the force of law and without any conditions, while the contemporary trend has adopted and supported the principle of independence in nationality in the family for the wife and adult children, except the exception contained in Article 11 of the Code of Algerian Nationality. According to it, there is no influence of a foreigner’s citizenship on his wife and adult children at all, on one hand because of the respect of the wife’s will, as far as the citizenship is concerned, and to avoid describing the adult children as dependents.
