جريمة التهرب الضريبي في القانون الجبائي الجزائري

Résumé: ىدؼ ىذا البحث لمتطرؽ إلى جريمة التيرب الضريبي والآليات القانونية لمكافحة التيرب الضريبي، مستخدميف في ذلؾ المنيج الوصفي لوصؼ مختمؼ الجوانب التي تتعمؽ بالد ا رسة، حيث توصمت مف خلبؿ ىذه الد ا رسة إلى عدة نتائج أىميا أف التيرب الضريبي ظاىرة مستفحمة بكثرة في أوساط المكمفيف بالضريبة مما أصبح يشكؿ خط ا ر كبي ا ر عمى اقتصاد الدوؿ مف جية كما أنو بات ييدد الاستق ا رر السياسي اولاجتماعي مف جية أخرى وذلؾ نظ ا ر لتفاق آثاره السمبية و تنوع أشكالو و طرقو مما جعؿ الإدارة الضريبية تجد صعوبات كبيرة في تتبعو وقياس حجمو إلا أنيا سعت وما ا زلت تسعى مف أجؿ مكافحة ىذا الداء والعمؿ عمى الحد مف انتشاره لحماية مداخيؿ الخزينة العامة لمدولة و ذلؾ مف خلبؿ اتباع سياسة جبائية والمتمثمة في الرقابة الجبائية التي تعد آلية قانونية ناجعة لمحاربة ىذه الآفة وذلؾ في حالة تطبيؽ إج ا رءاتيا بص ا رمة.The aim of this research is to address the crime of tax evasion and the legal mechanisms to combat tax evasion, using the descriptive approach to describe the various aspects related to the study. It has a great impact on the economy of countries on the one hand, and it is now threatening political and social stability on the other hand, due to the exacerbation of its negative effects and the diversity of its forms and methods, which made the tax administration find great difficulties in tracking it and measuring its size, but it has sought and is still seeking to combat this disease and work to reduce it. From its spread to protect the revenues of the public treasury of the state, by following a fiscal policy of fiscal control, which is an effective legal mechanism to combat this scourge, if its procedures are strictly applied.
