التأثيرات الخارجية على عمل المحكمة الجنائية الدولية

Résumé: إن إنشاء المحكمة الجنائية الدولية يعد في حد ذاته انجازا مهما، يؤكد ذلك ما قامت به من متابعات ضد عدد من المتهمين بارتكاب جرائم تدخل في اختصاصها، الا أن هناك تحديات عرقلت مسيرتها في ردع مرتكبي تلك الجرائم، بعض تلك التحديات مرتبطة بتأثير عوامل خارجية غير مرتبطة باختصاصاتها، أو تكوينها وإدارتها، أو إجراءاتها. الهدف من هذه الدراسة استجلاء تلك التحديات وتقديم مقترحات للمساهمة في تحسين دور المحكمة اعتمادا على المنهجين الوصفي والتحليلي. Abstract: The establishment of the International Criminal Court is in itself an important achievement, This is confirmed by its follow-up against a number of persons accused of crimes within its competence . However, there are challenges that hindered its path in deterring the perpetrators of those crimes, some of those challenges are related to the influence of external factors unrelated to its competencies, composition, management, or procedures. The main aim of this study is to show these challenges and provide proposals to contribute in order to improve the role of the court, based on the descriptive and analytical approaches. .
