عقد التأمين الرياضي Sports Insurance Contract

Résumé: ملخص : يعتبر عقد التأمين الرياضي آلية قانونية وأداة ضرورية لحماية الرياضيين والجمهور والغير من الأضرار التي تسببها المخاطر الرياضية، فبموجبه يصبح من حق المتضرر مطالبة المؤمن بالتعويض متى توافر في عقد التأمين الرياضي الشروط والأركان الخاصة به،وعقد التأمين الرياضي له نوعان إماأن يكون عقد تأمين ضد الحوادث الرياضية أو عقد التأمين من المسؤولية الرياضية ، وكلا النوعان من هذا العقد يرتبان جملة من الإلتزامات القانونية والتي تقع على عاتق المؤمن له وإلتزامات أخرى تقع على عاتق المؤمن، ويكون الإلتزام الرئيسي للمؤمن له في كل عقود التأمين هو دفع الأقساط للمؤمن وإلتزام المؤمن هو دفع مبلغ التأمين في حالة تحقق الخطر المؤمن له. Abstract: Sports insurance act is a legal mechanism and necessary tool to protect sportsmen and sportswomen, people and third persons against damages provoked by sports dangers. Regarding such a legal document, the claimant asserts his right to be compensated from the insurer if the insurance act contains conditions and clauses on the matter.There are two types of sports insurance acts, those that insure sports events and those concerned by sportive responsibility. However, both types provide a set of engagements that are the insured's responsibility and are others the insurer's responsibility. The main insured's engagement, in all insurance acts, is to pay advances to the insurer whose main engagement is to pay an insurance amount to the insured in case of dangers endured by this latter.
