أساس تطبيق القانون الأجنبي أمام المحاكم الجزائرية

Résumé: تلعب قاعدة تنازع القوانين في العلاقات الدولية الخاصة دورا كبيرا في تحديد القانون الواجب التطبيق، فيمكن لها أن تعين قانون وطني واجب التطبيق، كما يمكن أن تعين قانون أجنبي، أي أنها ذات خاصية مزدوجة فإدا عينت قانون قاضي الدعوى فلا إشكال يطرح، فالقاضي سوف يطبق قانونه، أما إدا عينت قانونا أجنبيا واجب التطبيق هنا يطرح الإشكال، لانه هناك أنظمة تقضي بتطبيق القانون الأجنبي، بينما هناك أنظمة تقضي غير ذلك، إذا كيف سوف يتعامل القاضي الوطني مع ذلك القانون الذي عينته قواعد الاسناد في قانونه وكيف سوف يعامله، إذا كان نظامه القانوني يقضي بتطبيق القانون الأجنبي الذي عينته قاعدة التنازع في قانونه الوطني The rule of conflict of laws in private vinternational relations plays a major pole in determining the applicable law since I can designate an applicable national law as well as a foreign law soit presents a double feature If it specifies the law of the judge of the case no problem arises If it specified an applicable foring law here it is problematic because there are systems to apply forign law while ther are legal systems that require sometging else so how will the national hudge deal with this law which defined by the rules of attribution in his law and how he wil treat it if are legal systems reguires the application of the foriegn law that is designated by the rule of conflict in the ,ational laws
