الوساطة الجنائية في جرائم الأحداث Criminal Mediation In Juvenile Crimes

Résumé: لقد أصبحت الوساطة الجزائية في الوقت الحاضر إحدى المصطلحات المألوفة والواسعة الانتشار في القانون الجنائي المقارن، اهتمت بها العديد من الندوات والمؤتمرات الدولية وأقرتها أغلب الدول في تشريعاتها الوطنية. تعتبر الوساطة الجزائية في جرائم الأحداث من أهم الآليات المستحدثة التي جاء بها المشرع الجزائري في قانون حماية الطفل ، وذلك من خلال إيجاد حلول ودية بين الحدث الجانح والضحية على النحو الذي يحقق رضا متبادل بينهما دون اللجوء إلى تحريك الدعوة العمومية. إذ أنها تكفل للمتخاصمين وسيلة فعالة لإصلاح الآثار التي خلفتها الجريمة ، مما يؤدي من جهة أخرى إلى التخفيف من عبء القضايا على كاهل القضاء. Abstract: At the present time, criminal mediation has become one of the familiar and widespread terminology in comparative criminal law. Many international seminars and conferences have taken interest in it, and most countries have approved it in their national legislation. Criminal mediation in juvenile crimes is one of the most important mechanisms developed by the Algerian legislator in the Child Protection Law, by finding amicable solutions between the juvenile and the victim in a manner that achieves mutual consent between them without resorting to public advocacy. As it guarantees to the litigants an effective way to repair the effects left by the crime, which on the other hand leads to lightening the burden of cases.
