تدخل وزير العدل في مؤسسة المجلس الأعلى للقضاء وأثره على استقلالية السلطة القضائية

Résumé: الملخص: المجلس الأعلى للقضاء هو أحد الأدوات المؤسسية التي تعنى بتسيير المسار المهني للقضاة، وقد كان الغرض من احداث هذه المؤسسة هو منع تدخل السلطة التنفيذية في الشؤون الداخلية للقضاة حفاظا على استقلالية القاضي كفرد، واستقلالية القضاء كمؤسسة. غير أن القانون الجزائري منح لوزير العدل حافظ الأختام بصفته المشرف الإداري الأول على قطاع العدالة مجموعة من الصلاحيات والسلطات التي جعلته يحظى بمكانة متميزة في المجلس الأعلى للقضاء، مما قد يؤثر بشكل سلبي على أداء مؤسسة المجلس الأعلى للقضاء ويحد من فاعلية أداء مهمتها في مجال تسيير المسار المهني للقضاة، وكضامنة لاستقلالية السلطة القضائية. Abstract: The Supreme Council of Magistracy is one of the institutional tools for managing the professional career of judges. The purpose of this institution was to prevent the interference of the executive branch in the internal affairs of judges in order to preserve the independence of the judge as an individual and the independence of the judiciary as an institution. However, Algerian law granted the Minister of Justice Hafez al-Seals as the first administrative supervisor of the justice sector a set of powers and authorities that made him a privileged position in the Supreme Council of the Judiciary, which may negatively affect the performance of the institution of the Supreme Council of the Judiciary and limit the effectiveness of its task in the conduct of the process Professionalism of judges, and as a guarantor of the independence of the judiciary.
