أحكام نسب الولد غير الشرعي في ضوء الفقه الإسلامي والتشريع الجزائري.

Résumé: ملخص: تهدف هذه الدراسة إلى معرفة مدى اعتراف الشريعة الإسلامية والقوانين الوضعية لولد الزنا بالانتساب إلى أبيه بعد اتفاقهم قولا واحدا على انتسابه لأمه. وقد اختلف الفقهاء حول هذه المسألة إلى قولين، بين معترف له بالانتساب إذا ادعاه واستلحقه به، ومانع له من الانتساب ولو ادعاه واستلحقه به، وبعد عرض أدلة الفريقين ومناقشتها رجحنا رأي الجمهور القائل بأن ولد الزنا لا يُنسب إلى الزاني ولو ادعاه واستلحقه به، نظرا لدلالة النص الصريح "وللعاهر الحجر"، وقد كان موقف المشرع الجزائري الأسري حول هذه المسألة يتميز بالغموض وذلك بعدم وضعه لقواعد منظمة لأحكام ولد الزنا رغم تجريم قانون العقوبات لفعل الزنا. Abstract: The study aims at knowing the extent to which Islamic Sharia'a and the positive laws concerning the son of Zina recognize its father's affiliation after they agree on one saying that he is its mother's affiliation. The two jurists were different on this issue, between affiliate recognized if claimed and deserved on the one hand. On the other hand, object to affiliation even if claimed and deserved because of the explicit text "And the prostitute stone", The Algerian family legislation in this matter is characterized of being ambiguous as well as hesitation for the fact that it did not legislate an organized provisions.
