" دور الجباية الأيكولوجية في الموازنة بين متطلبات التنمية والمحافظة على البيئة " The Role Of Ecological Tax In Achieving Balance Between Develoment And Preservation Of The Environnement

Résumé: الملخص: تعد كل من البيئة والتنمية من الحقوق المكرسة بموجب المواثيق والدساتير الوطنية، حيث سعى المشرع الجزائري إلى إيجاد توازن بين هذين الحقين وذلك من خلال تدخله عن طريق آليات الضبط البيئي لتحقيق التوازن بين متطلبات التنمية ومقتضيات حماية البيئة، ومنها الجباية الإيكولوجية والتي تؤثر بشكل مباشر في التنمية، والتي قد تكون مقيدة للعملية التنموية أو منظمة لها. إن الجباية الأيكولوجية تساهم بدور فعال في حماية البيئة من خلال الضرائب والرسوم التي تفرضها الدولة، وبالتالي فهي تضبط النشاطات التي يمارسها الأشخاص الطبيعيون أو المعنويون، وذلك أنه من يحدث أكثر ضررًا بالبيئة يدفع الضرائب أكثر، وذلك كعقوبة لتدمير البيئة وردعه عن التلويث، كما تساهم في مساعدة الدولة في تصليح الأضرار التي يخلفها الملوثين ولكن لا يمكن لهذه الآلية أن تساهم في حماية البيئة إلا إذا كانت هذه الرسوم أو العقوبات المالية تتناسب ودرجة التلويث. الكلمات المفتاحية: البيئة، التنمية، الجباية الأيكولوجية، الملوث الدافع، الضبط البيئي. Summary: Both environment and development are rights enshrined in national charters and constitutions .Algerian legislator sought to find a balance between these two rights. Through his intervention through environmental control mechanisms to balance development requirements of environmental protection. Including eco-tax which directly affect development, which might be tied to developmental process or organized it. This eco-tax to contribute to an active role in environmental protection through taxes and fees imposed by the State And thus control and regulating the activities of natural or moral persons If any of them cause more damaging to the environment pays more taxes , as a penalty for the destruction of it. It also contributes to assisting the State in repairing damage caused by polluters, but this mechanism can contribute to the protection of the environment only if such fees or financial penalties are commensurate with the degree of pollution.
