أحكام زواج ذوي الاحتاجيات الخاصة في الفقه الاسلامي
Résumé: "الملخص موضوع المذكرة موسوم ب: ""أحكام زواج ذوي الاحتياجات الخاصة في الفقه الإسلامي""، وإشكاليته الرئيسة: ما الأحكام الشرعية المتعلقة بزواج ذوي الاحتياجات الخاصة؟ تمت معالجة الموضوع ودراسته من خلال مباحث ثلاث، أما المبحث الأول فتعلق ببيان حقيقة ذوي الاحتياجات الخاصة من خلال التعريف وبيان أنواع الإعاقة وأسبابها، والمبحث الثاني تناول الموقف الشرعي من ذوي الاحتياجات الخاصة وأوضح مظاهر الشريعة ومنهجها في العناية بهم، والإطار الشرعي العام في التعامل مع هذه الفئة، أما المبحث الثالث فتطرق إلى مسائل فقهية متعلقة بالحكم الشرعي لزواجهم. ومن أهم النتائج المتوصل إليها، أنه لا حرج في زواج ذوي الاحتياجات الخاصة، مادام قادرا على ذلك ولا مانع من موانع الوطء لديه بالإضافة لعلم الطرف الثاني بإعاقته ورضاه. كما توصي الدراسة بـ: دعم الأعمال العلمية الخاصة ببيان أحكام الشريعة التي تحفظ حقوق هذه الفئة. "Abstract The subject of the research is about ""provions for the marriage of people with special needs in Islamic fikh"",and its main problem is: what are the legal rulings related to the marriage of people with special needs? The subject has been studied through three sections, the first topic is related to the statement of the reality of people with special needs through the definition and statement of the types ofdisabilties and their causes. However,the second topic deals with the lehgal. Position of people with special needs and clarifies the aspect of sharia and confronting them in caring for them and the general sharia formework in dealing with this category. As for the third topic, it deals with fikhissues related of the legal ruling on their marriage. Among the most important findigs, is that there is nothing with marrying aperson with special needs as long as he is able to do so and thereis no objection to intercourse with him.in addition, to the knowledge of the second party of this disability and his conent. The study also recommends: supporting scientific workerelated of the statement of sharia provisions that preserve the rights of this category. "
