الحماية الدستورية لحقوق المرأة "دراسة تحليلية في ضوء القانون الأساسي الفلسطيني"

Résumé: عبر الحماية الدستورية خط الدفاع الأهم عن الحقوق، وتزداد أهمية هذا النوع من الحماية إذا تعلقت هذه الحقوق بالمرأة التي عانت قديماً وحديثاً من صور الاضطهاد والتمييز، وتهدف هذه الحماية لضمان تمتع المرأة بحقوقها السياسية والمدنية وكذلك حقوقها الاقتصادية والاجتماعية والثقافية أسوة بالرجل بما يتناسب مع طبيعتها وخصوصيتها، حيث نجد أن الحماية الدستورية تتمثل في العديد من الضمانات للحفاظ على هذه الحقوق، حيث أن من أهم هذه الضمانات مبدأ المساواة وكذلك مبدأ السمو الدستوري وأخيراً مبدأ سيادة القانون. Abstract Constitutional protection is the most important line of defense for rights, and the importance of this type of protection increases if these rights relate to women who have suffered in the past and recent from forms of persecution and discrimination. This protection aims to ensure that women enjoy their political and civil rights, as well as their economic, social and cultural rights, equally with men, in proportion to their nature and privacy. where we find that constitutional protection is represented in many guarantees to preserve these rights, as one of the most important of these guarantees is the principle of equality as well as the principle of constitutional supremacy and finally the principle of the rule of law.
