إشكالات الاختصاص النوعي لمادة الصفقات العمومية في التشريع الجزائري

Résumé: نظم المشرع الجزائري قواعد الاختصاص القضائي في مادة منازعات الصفقات العمومية ضمن قانون الإجراءات المدنية و الإدارية وكذا المرسوم الرئاسي 15 -247 المتضمن تنظيم الصفقات العمومية و تفويضات المرفق العام ، غير أن ذلك التنظيم طرح العديد من الإشكاليات على المستوى التطبيقي الأمر الذي قد يؤدي إلى تنازع الاختصاص بين الجهات القضائية خاصة في ظل نظام الازدواجية القضائية الذي تعيشه الجزائر. The Algerian legislation has established the rules of jurisdiction of the article of disputes of public transactions within the code of civil and administrative procedures and also the presidential decree n15/247 which includes the public transactions and mandates of the general authority but this regulation raised many problems at the applied level which may lead to conflicts of jurisdiction especially in the light of the judicial duplicity experienced by Algeria.
