علاقات التعاون اللامركزي بين الجماعات الاقليمية الجزائرية والأجنبية

Résumé: مكّن المشرع الجزائري الإدارة المحلية بموجب قانون البلدية والولاية من إقامة علاقات تبادل وتعاون مع جماعات إقليمية تابعة لدولة أجنبية، على أن تحترم الإدارة المحلية في إبرامها لاتفاقية التعاون والتبادل للضوابط والقيم والثوابت الوطنية والالتزامات الدولية للجزائر. واشترط المشرع ألاّ تخرج الجماعات المحلية في ذلك عن نطاق صلاحياتها. يتعيّن على الإدارة المحلية عند إبرامها لاتفاقية التعاون والتبادل اتباع الخطوات التي بينها المرسوم التنفيذي 17-329 كما يتعيّن عليها الحصول على الموافقة المسبقة من الوزير الأول، مع وخضوعها لرقابة وصائية من طرف وزير الداخلية أو الوالي حسب الحالة. The Algerian legislator has allowed local administration under municipal law to establish relationships of exchange and co-operation with foreign local authorities, in which the local administration respects national values, constants and the international obligations of Algeria. And it should not go beyond its authorities. The executive decree 17-329 sets out the steps to be followed by the Algerian local administration to conclude cooperation and exchange agreement with a foreign local administration, and it must also obtain the prior approval of the Prime Minister, and subject the supervision of the Minister of the Interior or the Prefect, as the case.
