Résumé: الملخص: تُعدُّ فكرة مجلس التعاقد عن بعد فكرة قديمة، حيث إن فقهاء الشريعة الإسلامية أصَّلوا لها تأصيلا شرعيا، ولأن العقود عندهم كانت كذلك تتم عبر الرسائل، ولكن بعد أن تطورت الحياة عند الناس ظهرت ما يسمى بالعقود الالكترونية، وتعتبر هذه العقود كغيرها من العقود التقليدية، غير أن هذا النوع من العقود يتم عن بعد، وذلك باستخدام شبكة الانترنت ، فالأركان الأساسية للعقود؛ الإيجاب والقبول يتم التعبير عنها عن طريق البريد الالكتروني، أو المحادثة التي تتم بين طرفي العقد في مجلس واحد كما هو معروف في العقود العادية، بمعنى أن التعاقد الإلكتروني يكون بين حاضرين زمانا و غائبين مكانا، كما يمكن أن يكون بين غائبين زمانا و مكانا. أما بالنسبة لتحديد زمان ومكان إبرام العقد فهما مسألتان مهمتان، لأنه بتحديد زمان العقد تتحد مسائل هامة نصت عليها القواعد العامة للعقد، فيكون زمان انعقاد العقد الالكتروني في الوقت الذي يصل فيها القبول للموجب، أما بالنسبة للمكان فبتحديده يمكن معرفة القانون الواجب التطبيق وكذا المحكمة المختصة في حالة وجود نزاع بين أطراف العقد الالكتروني.
