عود العلة على النص بالإبطال أوالتعميم أو التخصيص وأثره في الفهم المقاصدي للسنة النبوية قراءة في ضوء تطبيقات العلامة ابن دقيق العيد
Résumé: ملخص: إن المتتبع لتطبيقات المعاصرين لعلم المقاصد في فهم نصوص السنة النبوية يجد الغلو والإفراط والإيغال في اتباع المعاني ولو على حساب هدم المباني، كما يجد الحرفية السطحية الجامدة على النص، ومن ههنا يتساءل الباحث عن مثار هذا التباين في الفهم المقاصدي للسنة النبوية، وقد أماط الإمامابن دقيق العيداللثام وأرشد الأعلام إلى قضية مهمة؛ وهي أنه يشترط في العلة المستنبطة ألا تعود على النص بالإبطال، ووظفها في جملة من المسائل المنتزعة من أحاديث السنة النبوية. Abstract: The observer of contemporary applications of the science of objectives in understanding the texts of the Prophet’s Sunnah will find exaggeration, excess and negligence in following the meanings, even at the expense of demolishing buildings.He also finds the superficial and rigid literalism of the text, and from here the researcher wonders about the implications of this difference in the intended understanding of the Prophet’s Sunnah. Imam IbnDaqiq AlEid unveiled and guided the scholars to an important issue. And it is that it is stipulated in the inferred reason that it should not be accustomed to the text by nullifying, and employing it in a number of issues extracted from the hadiths of the Prophet’s Sunnah.
