الضوابط الإقتصادية للمصلحة العامة بخصوص استغلال براءات الإختراع

Résumé: إنّ تطور الأمم يقاس بما تحوزه من مخترعات التي تعدّ علامة من علامات التطور والتحضر، ومن ثم اهتم الأمر رقم 03-07 المتعلق ببراءات الإختراع بإحاطة المخترع بحق احتكاري استئثاري لقاء ما بذله من جهد علمي للوصول إلى اختراع يساهم في تحقيق التنمية الاقتصادية، كما تمّ ابراز مدى تأثير الضوابط الاقتصادية على نطاق المصلحة العامة عند الاستغلال الإرادي لبراءات الاختراع، وعلى سَنّ القوانين التي تستجيب للمتطلبات الاقتصادية وحاجيات الافراد من أجل الموازنة بين مصلحة الفرد من حيث تحصيل الأرباح ومصلحة المجتمع المتمثلة في استغلال التكنولوجيا لتطوير الاقتصاد من جهة، ومن جهة أخرى مدى تأثير ذات الضوابط الاقتصادية عند الاستغلال الاجباري لبراءات الاختراع سيما عند تقاعس مالك البراءة في استغلال اختراعه وهنا يسوغ للسلطات المختصة استصدار التراخيص الاجبارية لاستغلال الاختراع في حالات وبمراعاة ضوابط معينة، كما يجوز للدول الأعضاء إضافة صور أخرى دون التقيّد بتلك الضوابط سيما اذا ما تعلق الامر بالمحافظة على الامن القومي، البيئة، الصحة. وفي الأخير نخلص إلى أنّه بالرغم من قواعد المرونة التي تضمنتها اتفاقية تريبس لمساعدة الدول النامية لبناء قاعدة تكنولوجية اقتصادية إلا أنها غلّبت مصالح الشركات المتعددة الجنسيات باعتبارها تمتلك العدد الأكبر من براءات الاختراع وعملت على تقوية نفوذها في انحاء الدول النامية بما في ذلك الجزائر، مما يستدعي القول أنّ اتفاقية تريبس صناعة الدول المتقدمة بامتياز.Le progrès des nations est mesuré par le nombre de brevets d'invention quelle détient, celui-ci représente un signe de développement, de ce fait l'ordonnance n°03-07 relative au brevet d'invention a accordé à l'inventeur un droit monopolistique et exclusif en contrepartie des efforts fournis dans le cadre du processus d'invention et participer au développement économique. Et en fin de compte on déduit que malgré les règles de flexibilité édictés par la convention Trips pour aider les pays de tiers monde afin de construire une base technologique et économique, cependant elle a favorisé les intérêts des sociétés multinationales du fait qu'elle détient le plus grand nombre des brevets, ainsi elle a renforcé son influence au sein des pays de tiers monde y compris l'Algérie, ce qui nous emmène à déduire que la convention Trips est une production exceptionnelle des pays développés.
