غرامة الصلح كآلية لتسوية المخالفات المتعلقة بالتجارة الإلكترونية

Résumé: أصبحت المعاملات التجارية عبر الوسائط الإلكترونية اليوم تطغى على التجارة في صورتها التقليدية, وذلك لسرعة التعامل عبر الإنترنت, وشساعة نطاقها وتنوع أسواقها والمتعاملين عبرها من مستهلكين وموردين إلكترونيين. وبناء على هذا التطور كثرت المخالفات في هذا المجال, ووجب وضع قواعد عقابية واحترازية, للحد من المخالفات الواقعة على المستهلك من قبل المورد الإلكتروني, وهذا ما أدى بالمشرع الجزائري لوضع العديد من العقوبات والتدابير لأجل هذا الغرض, ومن هذه التدابير غرامة الصلح والتي أقرها في قانون التجارة الإلكترونية, بهدف تخفيف العبء على القضاء وتسريع إجراءات فض النزاع القائم بين المورد الإلكتروني والإدارة المكلفة بحماية المستهلك.
