القانون الواجب التطبيق على النسب في عقود الزواج الدولية

Résumé: يعتبر موضوع النسب من بين المواضيع الحساسة في مجال تنازع القوانين نظرا للإشكالات المتعلقة بإثباته في العلاقات الخاصة ذات العنصر الأجنبي أو بالأحرى في عقود الزواج المختلط، ومن بين الأحكام المستحدثة في تعديل القانون المدني الجزائري لسنة 2005 ذات الصلة بتنازع القوانين إضافة مادة في القانون الشخصي وهي المادة 13 مكرر التي تعتبر قاعدة إسناد خاصة بالنسب الشرعي من اجل مواجهة إشكالات الزواج المختلط للجزائريين والجزائريات مع الأجانب، إلا أن هذه الأخيرة تثير إشكالات قانونية من الناحية العملية. Among the sensitive questions in the field of conflicts of laws, we find the question of parentage and the problems of its proof in international private relations, or rather in mixed marriage contracts, and among the new provisions introduced in the amendment of the Algerian Civil Code in 2005, the rule relating to conflicts of laws in determining the law applicable to parentage, article 13 bis, which is considered as an adequate conflict rule regarding legal parentage to deal with the problems of marriage mixed Algerians with foreigners. But the aforementioned article raises legal problems in practice.
