آليات الوقاية من جرائم عصابات الأحياء السّكنية في إطار الأمر رقم 20- 03 بين المعمول والمأمول

Résumé: شهدت الجزائر في العشرية الأخيرة ارتفاعًا ملحوظًا في منحى الظّاهرة الإجرامية، خاصة بعد ظهور ما يُسمى بـ"عصابات الأحياء"، وهي عبارة عن جمعيات أشرار منظّمة تُباشر سلسلة أعمال إجرامية خطيرة على مستوى الأحياء السّكنية ممّا يُهدد سلامة وممتلكات المواطنين، ممّا تطلّب على المشرّع الجزائري إصدار الأمر رقم 20-03 المتعلق بالوقاية من جرائم عصابات الأحياء ومكافحتها، تبنى من خلاله إستراتيجية مُحكمة تجمع بين الوقاية والرّدع مع إشراك الدولة والمؤسسات العمومية والمجتمع المدني والإعلام كعضو فعّال ومقاومٍ لها. لكن، رغم أهمية هذه الإستراتيجية تبقى محدودة الفعّالية، فجرائم عصابات الأحياء في تزايدٍ مستمرٍ، ممًا يتطلب إعادة النّظر فيها على نحو سدّ الثغرات والنقائص فيها. Abstract : The criminal phenomenon has recently increased in Algeria due particularly to the growing number of neighbourhood gangs, in the form of organized groups that carry out criminal acts at residential neighbourhood and that threaten people’s lives and properties. This leads the Algerian legislator to issue Order N°.20-03 related to the prevention and control of neighbourhood gangs, , with the adoption of a set of preventive measures and mechanisms to reduce these gangs, executed by specialized committees, in addition to involving the state, civil society and the media as an effective member. However, despite the importance of this strategy, it remains limited in effectiveness, as the crimes of neighbourhood gangs prevail and are constantly increasing, which requires a review of this strategy in a way that covers its gaps and remedies the deficiencies.
