الزواج العرفي بين الآليات القانونية لتسجيله و الإجراءات القضائية لإثباته

Résumé: تعدّ مشكلة إثبات العلاقة الزوجية في الزواج العرفي الذي لا يمكن الاحتجاج به من طرف الزوجين إلا بعد تسجيله،من أخطر المشاكل في العصر الحاضر بل من أدقها و أعمقها،و هذا بمجرد أن تطفو خلافات بينهما،فيتهرب أحدهما من الالتزامات المفروضة عليه بمقتضى هذا العقد سواء في مجال النسب أو الإرث.مما يستلزم إثباته بحكم قضائي وفق إجراءات قانونية،هذا ما يقودنا إلى دور النيابة العامة في مثل هذه القضايا على اعتبارها طرفا أصيلا. Abstract: The problem of establishing marital relationship in a customary marriage, which cannot be invoked by the spouses until it has been registered, One of the most serious problems of the present day, but one of the most accurate and deepest, once their differences have afloat, One or both of them evade the obligations imposed on them under this contract, whether in the area of descent or inheritance, which requires proof by judicial decision in accordance with legal procedures, This leads us to the role of the Public Prosecutor's Office in such cases as an authentic party.
