المصالحة في جرائم التهريب بين مقتضيات السياسة الجنائية والإعتبارات الإقتصادية

Résumé: الملخص: تعتبر جرائم التهريب من أخطر الجرائم التي تنخر الإقتصاد الوطني، الأمر الذي أدى بالمشرع إلى التدخل لمكافحة هذه الجريمة من خلال سن قانون خاص لقمع التهريب، تضمنه عدم جواز مصالحة المخالفين لتشريع والأنظمة الجمركية التي تسهر إدارة الجمارك على تطبيقها، مما نتج عنه تراكم قضايا التهريب في أروقة المحاكم وبالنتيجة بطء إجراءات تحصيل تعويضات وغرامات لفائدة الخزينة العمومية لجبر الضرر الذي لحق بها، مما يستوجب إعادة النظر في السياسة الجنائية المتبعة لقمع التهريب من خلال فتح باب المصالحة أمام المخالفين أسوة بالجرائم الجمركية الأخرى وجرائم تهريب النقد، وذلك بتغليب الطابع التعويضي على العقاب الجسدي. Abstract: Smuggling crimes are considered one of the most serious crimes that harm the national economy, which led the legislator to intervene to combat this crime by enacting a special law to suppress smuggling, which included the impermissibility of conciliation with violators of customs legislation and regulations that the customs administration is keen to implement, which resulted in the accumulation of smuggling cases in As a result, the procedures for collecting compensation and fines for the benefit of the public treasury to redress the damage caused to it are slow, which necessitates a reconsideration of the criminal policy used to suppress smuggling by opening the door to reconciliation for violators similar to other customs crimes and cash smuggling crimes, by giving priority to the compensatory nature over corporal punishment.
