Résumé: ملخص المقال: هناك العديد من المدارس الفلسفية التي تناولت حقوق الإنسان ودور الفرد في المجتمع من حيث علاقته بالدولة و المواطنة. لقد حاولت المدارسالفلسفية الغربية الحديثة و اتجاهاتها و ضع أسس النظريات الفلسفية حول الإنسان ككائن حي له الحق في أن يتمتع بأوجه الحياة السياسية والاجتماعية والاقتصادية والثقافية التي تحتاج إلى تنظيم قانوني يوازيه ما يجب أن يتمتع به الشخص من حرية ،وما يجب عليه أن يقدمه باعتباره جزءا من نظام اجتماعي وقانوني . يتزايد اهتمام الفلسفة بموضوع حقوق الإنسان بسبب التنافس المحتدم بين الفلاسفة والحقوقيين حول مشروعية حقوق الإنسان وأحقية الحديث عنها. يهدف هذا المقال إلى مناقشة أو بيان مكانة و مفهوم حقوق الإنسان في الفلسفة الغربيةالحديثة وذلك من خلال طرح التساؤل حول علاقة الفلسفة بحقوق الإنسان، وحول مشروعية الحديث الفلسفي في هذا الموضوع. Abstract : There are many philosophical schools that dealt with human rights and the role of the individual in society in terms of his relationship between the state and the citizenship .The philosophical theories that discussed the human condition as a living being has the right to enjoy the aspects of political, social, economic and cultural life, what a person should enjoy, as part of a social and legal system. This article try toclarify the question or relationshipbetweenoccidental modern philosophyandhumanrights,according the legitimacy of philosophicaldiscourse.
