أساليب إعادة التربية والادماج داخل مؤسسات العقابية في التشريع الجزائري

Résumé: ملخص : لم تعد الأساليب العقابية القائمة على الردع كافية؛ للقضاء على الجريمة ،وأمام هذا الوضع تم إخضاع الأشخاص المنحرفين إلى برنامج علاج العقابي ذات النظم التمهيدية ،ومتمثل في الفحص والتصنيف، إلا أن المشرع الجزائري بموجب القانون 05/04 المتضمن قانون تنظيم السجون وإعادة الادماج الاجتماعي للمحبوسين استحدث آليات عقابية جديدة داخل المؤسسة العقابية تهدف إلى تأهيل الجاني عن طريق إشراكه في الإصلاح العقابي من خلال التعليم والتهذيب ، مواكبا بذلك تطورات المنظومة العقابية . Abstract: Punitive methods based on deterrence are no longer sufficient to eliminate crime, and in the face of this situation, deviant persons have been subjected to a punitive treatment program with pre-existing systems, represented in the examination and classification, but The Algerian legislator, under law 05\/04, which includes the Law on The Organization of Prisons and the Social Reintegration of Prisoners, has introduced new punitive mechanisms within the penal institution aimed at rehabilitating the offender by involving him. In punitive reform through education and politeness, keeping pace with the developments of the penal system.
