الحماية الجزائية للحقوق العمالية وذاتية المسؤولية الجزائية في قانون العمل

Résumé: إذا كان القانون الجزائي بشكل عام مجموعة من القواعد القانونية التي تبين للمخاطبين به جملة الأفعال المجرمة والعقوبات المقررة لها، وهذا باعتباره الشريعة العامة في مجال التجريم والعقاب، غير أنه ولخصوصية بعض المجالات يمنح هذا القانون ذاتية جزائية في التجريم والعقاب وهو ما يعرف بالقوانين المكملة لقانون العقوبات والتي من أهمها قانون العمل. إذ تلعب النصوص القانونية في ظل قانون العمل دورا كبيرا في إضفاء حماية جزائية خاصة بالنسبة للعامل، وذلك باعتباره الطرف الضعيف في العلاقة التعاقدية العمالية التي تربط بين كل من المستخدم والعامل، ولقد اهتم المشرع الجزائري في هذا المجال بإعطاء ذاتية جزائية في قانون العمل وفق مجموعة من الأحكام والقواعد الجزائية التي يتوجب على أطراف العلاقة احترامها وعدم الإخلال بها، وأن مخالفتها تؤدي إلى قيام مسؤولية جزائية في حق المخال، وهذه الذاتية الجزائية في قانون العمل الهدف منها بالضرورة توفير الحماية الجزائية والأمن واستقرار علاقات العمل الفردية والجماعية. If the criminal law in general is a set of legal rules that clarify to its addressees the totality of criminalized acts and the penalties prescribed for them, and this is as the general law in the field of criminalization and punishment, however, due to the specificity of some areas, this law gives penal subjectivity in criminalization and punishment, which is what is known as the laws that complement the penal law. The most important of which is the Labor Law. The legal texts under the Labor Law play a major role in conferring penal protection, especially for the worker, as he is the weak party in the labor contractual relationship that links both the employee and the worker. Penal provisions and rules that the parties to the relationship must respect and not violate, and that violating them leads to penal liability against the uncle, and this penal subjectivity in the Labor Law is necessarily intended to provide penal protection, security and stability of individual and collective labor relations.
