التخفيف من الرقابة المسلطة على هياكل السلطة المحلية في تونس

Résumé: الملخص: أنه لا يستقيم تطبيق مبدأ التدبير الحر اذا كانت هياكل السلطة المحلية في تونس خاضعة لرقابة اشراف مشددة، فالرقابة تؤدي بالضرورة إلى تضييق حرية السلطة المحلية في ممارسة شؤونها المحلية ، وبالتالي فإن جميع أنواع الرقابة سواء كانت تمارس من قبل سلطة إشراف او بين هياكل السلطة المحلية ذاتها فهي غير ممكنة طبقا لمقومات هذا المبدأ لذلك فإن هذا الشكل من الرقابة لا بد من حذفه وفي المقابل تعزيز الرقابة الغير رسمية، إن اقرار مبدأ التدبير الحر للجماعات المحلية يبقى ضمانة حقيقية للاستقلالية الجماعات المحلية وخطوة جدية وفعلية نحو تنظيم لامركزي تكون فيه الكلمة والقرار لهياكل السلطة المحلية. Abstract : It is not correct to apply the principle of free management if the local authority structures in Tunisia are subject to strict supervision control, as control necessarily leads to narrowing the freedom of the local authority in the exercise of its local affairs, and therefore all types of control, whether it is exercised by a supervisory authority or between the structures of the local authority itself It is not possible according to the elements of this principle. Therefore, this form of oversight must be deleted, and in return, informal oversight should be strengthened. Adopting the principle of free management of local groups remains a real guarantee for the independence of local groups and a serious and effective step towards a decentralized organization in which the word and decision are for local power structures.
