دور الآليات القانونية في استرجاع عائدات جرائم الفساد - قراءة في ظل أحكام إتفاقية الأمم المتحدة لمكافحة الفساد لسنة 2003-

Résumé: الملخص : يكتسي موضوع استرداد العائدات المالية لجرائم الفساد المهربة للخارج والتي تم إخفاؤها في البنوك الدولية أهمية كبيرة على الصعيد الوطني والدولي نظرا لأثارها الوخيمة على الاستقرار الاجتماعي ، والتطور الاقتصادي للدول المهربة منها هذه الأموال ، ومنه تهدف هذه الدراسة إلى تقييم مدى فعالية آليات استرداد هذه الأموال والتي تم اعتمادها من خلال اتفاقية الأمم المتحدة لمكافحة الفساد لسنة 2003 والتي أثبتت فشلها لعدة أسباب ولعل من أهمها الافتقار للتعاون الدولي في هذا المجال. Abstract The recovery of financial proceeds of corruption offences, smuggled abroad and concealed in international banks , is a matter of great importance on both national and international levels, because of their pernicious effects on social stability and economic development of the affected states. The fact that requires us to combine international efforts against this phenomenon, and to eradicate all safe havens for the proceeds of crime. Therefore, the importance of this study is spotlight the mechanisms adopted by the 2003 United Nation Convention against Corruption, in order to recover the financial proceeds of corruption. Although, it failed to fight this phenomenon due to the poor international cooperation in this field
