مشتملات النفقة دراسة مقارنة بين الفقه الإسلامي والقانون الجزائري

Résumé: "تهدف هذه الدراسة إلى إبراز الحق المالي للزوجة، والمتعلق بالنفقة الزوجية والتي تثبت للزوجة بعد تمام العقد الصحيح وتصبح التزاما مستمرا على عاتق الزوج، وهذا الحق المالي تسبب في إثارة الخلاف والشقاق بين أفراد الأسرة الواحدة عند الامتناع عن دفعه. حيث حاولنا في هذا البحث التعرف على مشتملات النفقة الزوجية في الفقه الإسلامي والقانون الجزائري، وذلك بالتطرق إلى ماهية النفقة في الفصل الأول وكذلك إلى الامتناع عن دفع النفقة ومسقطاتها في الفصل الثاني. وخلص البحث إلى وجوب نفقة الزوجة على الزوج وهي حق مالي مكفول لها شرعا وقانونا، ولا تسقط إلا إذا توفرت حالات تؤدي إلى سقوطها. "This study aims to highlight the financial right of the wife, related to marital alimony, which is confirmed to the wife after the completion of the valid contract and becomes a continuing obligation on the husband. This financial right causes disagreement and discord among members of the same family when they refrain from paying it. In this research, we tried to identify the contents of alimony in Islamic jurisprudence and Algerian law by addressing the nature of alimony in the first chapter, as well as abstaining from paying alimony and its consequences in the second chapter. The research concluded that the wife is obligated to provide maintenance to the husband, which is a financial right guaranteed to her by law and law, and it is not waived unless there are circumstances that lead to it being waived
