الترجيح بالمقاصد عند ابن رشد الحفيد من خلال كتابه بداية المجتهد ونهاية المقتصد

Résumé: ملخص البحث نظرا لأهمية المقاصد الشرعية في استنباط الأحكام الشرعية والترجيح بينها، كانت حاجة الفقيه إليها ملحة ، وتظهر هذه الحاجة عند تعارض الأدلة الشرعية بحيث يتساوى الدليلان ويتعذر الجمع فعند ذلك نعتمد على مقاصد الشريعة في الترجيح ، من أجل ذلك ارتأيت تناول هذا الموضوع الترجيح المقاصدي عند ابن رشد الحفيد من خلال كتابه بداية المجتهد ونهاية المقنصد لأبين عمليا كيف يوظف ويفعل هذا العالم الجليل المقاصد في الترجيح بين الأحكام، فجاء البحث في ثلاثة مطالب أولها: تعريف مصطلحات العنوان ، الترجيح بالمقاصد، الثاني تطرقت فيه إلى النظر المقاصدي عند ابن رشد في النقاط: 1 - أحكام الشرع بين التعبد والتعليل 2 - الألفاظ التي لها صلة بالمقاصد عند ابن رشد 3 - تكييف الأحكام مع مقاصدها لبيان تفعيله للمقاصد ، والثالث: بيان ترجيحاته المقاصدية بأمثلة ، ثم خاتمة تضمنت أهم النتائج.
