حـجيـة الـدليـل الـرقمـي في إثبـات الجـريمـة المعـلـومـاتيـة

Résumé: يعتبر موضوع الدليل الرقمي من المواضيع التي شغلت فقهاء القانون الجنائي والمشرعين، وهذا في مجال الإثبات الجنائي على اختلاف نظمه، وهذا الاهتمام جاء نتيجة لكون الدليل الرقمي دليلا مستحدثا وذو طبيعة معقدة وصعبة، حيث ترتكز عملية الإثبات الجنائي للجرائم المعلوماتية على الدليل الجنائي الرقمي باعتباره الوسيلة الوحيدة والرئيسية لإثبات هذا النوع من الجرائم، لذلك يعد الإثبات الجنائي بالأدلة الرقمية من أبرز تطورات العصر الحديث في كافة النظم القانونية، تلك التطورات التي جاءت لتلائم الثورة العلمية والتكنولوجية والتقنية في عصرنا الحالي، والتي تطور معها الفكر الإجرامي، فظهر نوع جديد من الجرائم تعرف بالجرائم المعلوماتية. The topic of digital evidence is considered one of the topics that has occupied criminal law jurists and legislators, and this is in the field of criminal proof with its various systems. This interest came as a result of the fact that digital evidence is new evidence and of a complex and difficult nature, as the process of criminal proof of information crimes is based on digital forensic evidence as the only means. The main thing to prove this type of crime is, therefore, criminal proof using digital evidence is considered one of the most prominent developments of the modern era in all legal systems. These developments came to suit the scientific, technological and technical revolution in our current era, with which criminal thought developed, and a new type of crime emerged known as information crimes
