أحكام اللقيط و رعايته

Résumé: إن فئة الأطفال اللّقطاء أصبحت من أكثر القضايا المطروحة في المجتمعات عموما والمسلمة خصوصا، لذلك اهتم بها الفقه الإسلامي قديما وحديثا ، لآن من كلياته الخمسة حفظ النّفس، وذلك بالحثّ على التقاطهم و محاولة معرفة نسب اللّقيط إن أمكن ورعايته والتكفّل به وتربيته و توفير الحماية الاجتماعية و القانونية له و دمجه في المجتمع. إن القوانين الوضعية ومنها القانون الجزائري لم تتعرض لهذه الفئة بالتفصيل في قانون منفرد، بل جاءت متفرقة في عدة نصوص قانونية مختلفة . إن من واجب الدّولة والمجتمع حماية واحتواء فئة اللّقطاء و مجهولي النسب ورعايتهم والأخذ بيدهم لبر الأمان حفاظا عليهم وعلى تماسك المجتمع فأقرّت الكفالة و أنشأت دور للرّعاية البديلة،مع وضع قوانين ردعية للتّقليل منهم لما لهم من آثار وانعكاسات على أمن واستقرار المجتمع The category of foundlings has become one of the most frequently discussed issues in societies in general and in Muslim societies in particular, That is why Islamic jurisprudence has paid attention to it in the past and present , because one of , its five faculties is the human self (nafs) by searching them to be picked up and trying to find out the parentage of the foundling if possible , taking care of him, raising him, providing him with social and legal protections and integrating him into society. The positive laws , including the Algerian law , did not deal with this category in detail in a single law, but rather they were dispersed in several different legal texts. It's the duty of the state and the society to protect and contain foundlings and children of unknown parentage , to take care of them and to provide safety in order to preserve them and the cohesion of society. So foster care has been approved and alternative childcare homes have been established with deterrent laws in place to reduce them because of their effects and repercussions on the security and stability of societ. protection and containment of foundlings and children of unknown parentage is the duty of the state and the society, to take of them and to take their hand for safety in prder to preserve them and the cohesion of society lisped approved.
