المساقاة والمزارعة في المذهب المالكي
Résumé: تعرض الباحث لعقدي المساقاة والمزارعة في المذهب المالكي، فأفرد أحكامهما بالدراسة والبيان في مذهب إمام دار الهجرة، فبدأ بعقد المساقاة ( فعرفه وبين حكمه وأدلة مشروعيته وأركانه وأحكامه، وكذلك بالنسبة لعقد المزارعة. وخلص في النهاية إلى أنّ هذين العقدين من العقود الزراعية المهمّة في حياة النّاس لتأمين حياتهم المعيشيّة وتحرّرهم من التّبعيّة الأجنبيّة. The researcher studied the musaqah and muzar'ah contracts in the Maliki school, and devoted his attention to clarifying their provisions in the Imam Dar al-Hijrah school. By undertaking an analysis of the musaqah contract, clarifying its definition, legitimacy, pillars, and rulings, likewise, for the contract of muzar'ah. The researcher has concluded that these two contracts, of agricultural contracts, are crucial for people's livelihoods, liberating them from foreign dependence.
