الرقابة على الصفقات العمومية في ضوء أحكام المرسوم الرئاسي رقم 15-247

Résumé: الملخص: تعتبر الصفقات العمومية أهم الآليات التعاقدية التي تراهن عليها الدولة من أجل تحقيق تنمية اقتصادية واجتماعية، كما أنها تعد أداة وظيفية لضخ الأموال العامة وتسيير الاقتصاد الوطني. وباعتبار الصفقات العمومية القنوات المستهلكة للمال العام فقد أحاطها المشرع من خلال المرسوم الرئاسي رقم 15-247 بكافة الضمانات القانونية اللازمة لضمان شفافيتها ونجاعتها من أجل حسن استعمال المال العام وحمايته، وذلك عن طريق إلزام السلطات العمومية بالوقاية من كل أشكال الانحرافات المرتبطة بإبرام وتنفيذ وإنهاء الصفقات العمومية. وتوخيا لفعالية الصفقات العمومية أخضع المشرع الصفقات العمومية إلى أنواع متعددة من الرقابة المتمثلة في الرقابة الإدارية سواء كانت الرقابة السابقة الداخلية والخارجية أو الرقابة المالية اللاحقة للكشف عن التجاوزات القانونية والمالية وجرائم الفساد المتعلقة بالصفقات العمومية. Abstract: Public deals are the most important contractual mechanism that the state bets on in order to achieve economic and social development. It is also a functional tool for pumping public funds and running the national economy. Considering public procurement as the channels that consume public money, the legislator has informed them, through Presidential Decree No. 15-247, of all the legal guarantees necessary to ensure their transparency and efficacy for the proper use and protection of public money by obliging public authorities to protect against all forms of deviations associated with the conclusion, implementation and termination of public deals. In order to ensure the effectiveness of public deals, the legislator subjected public procurement to various types of control represented in administrative control, whether it was the internal and external precedent, or the subsequent financial control to reveal legal and financial abuses and corruption crimes related to public procurement.
