سلطة القاضي المدني في تقدير حجية الشهادة. دراسة مقارنة بين الفقه الإسلامي والقانون المدني الجزائري
Résumé: تسلط هذه الدراسة الضوء على السلطة التقديرية للقاضي المدني في التشريع الإسلامي وتطبيقاتها في القضاء الشرعي، وبالتحديد في الشهادة كدليل إثبات منتج في الوصول إلى الحقيقة القضائية، كما تم التعرض إلى تطبيقاتها في القضاء الجزائري الحديث، وقد تبين جليًا أهمية الشهادة، وشروط الشاهد، والحالات الخاصة التي لا يجوز الاستماع فيها إلى الشاهد. This paper deals with the judge’s estimated authority in judicial legislation and its applications in religious courts, which needs to clarify the concept of estimated authority, and its evidences of legislation. There were some discussions to certain application in recent Algerian judgments, such as estimating the importance of the witness; the eyewitnesses’ obligations, and the special cases where the evidence taken from an eyewitness is for bidden.
